Over at The Elder Care Law Firm Blog, Scott Stewart has an excellent article about an emerging trend: creating legal agreements to provide compensation for family members who care for older loved ones. Although this might seem unusual to those not familiar with in-home care for the elderly, it is an approach that can help make things fair in situations in which some family members help while others choose not to do so.
All too often we see situations in which one adult child (often the oldest daughter) of a Senior is the one who cares for an aging parent and who may even quit her job to do so, while her siblings stand by and watch. When that parent passes away, the non-caregiver adult children all receive the same share of the estate as the caregiver daughter, and in many cases that simply isn’t “fair”.
